By booking, accessing, or using any services provided by Kickoff Labs LLC (“Company”), you (“Client”) agree to these Terms of Use.
The Company provides entertainment-based robotic experiences operated by independent contractors and/or third-party operators. Services are provided “as-is” and “as-available.”
Client acknowledges that interaction with robots involves inherent risks, including but not limited to:
Client voluntarily assumes all risks associated with the use of the services.
To the maximum extent permitted by law:
Use of services is at Client’s sole risk.
Client agrees to indemnify, defend, and hold harmless Kickoff Labs LLC, its owners, operators, contractors, and affiliates from any claims, damages, liabilities, or expenses arising from: use of the services, actions of guests or third parties, event conditions or environment.
Robots may be operated by independent third parties. The Company:
7.1 Responsibility for Consent — Client is solely responsible for obtaining all necessary permissions, consents, and releases from any individuals (including minors) present at the event.
7.2 No Liability — The Company shall not be liable for unauthorized filming, use of likeness, or privacy claims.
7.3 Use of Content — Client grants Company the right to use event photos/videos for marketing and promotional purposes, unless otherwise agreed in writing.
Client agrees to:
The Company does not guarantee specific performance outcomes, uninterrupted operation, or compatibility with event conditions.
Participation in the affiliate program, including as a Referral Partner, does not create any partnership, joint venture, agency, or employment relationship between the Company and any participant.
All participants, including Referral Partners, act as independent contractors and have no authority to bind, represent, or act on behalf of the Company in any manner.
All payments are final and non-refundable, unless otherwise agreed.
The Company may refuse or terminate services at any time for safety or operational reasons.
These Terms shall be governed by the laws of the State of Delaware.
Any disputes shall be resolved through binding arbitration. Client waives any right to jury trial or class action claims.
